DUI laws vary by state, it is important to understand the laws specific to where you were charged in the transition from your defense. Most states impose different penalties depending on your level of intoxication. The state of Maryland is no exception.



Maryland DUI charges



There are three different types of drug and alcohol related costs that you can be convicted in Maryland. The penalties are more severe for your second offense they are for your first offense.



To determine whether or not you are drunk, the officer conducts a series of sobriety tests on you. If an officer suspects that you are impaired, it will ask you to submit to a breathalyzer test. If you refuse the breath test, your license is automatically suspended for 120 days and will be considered an admission of guilt before the court.



Impaired



If your blood alcohol concentration (BAC) ranges between 07 and .08, you will be charged with driving while impaired (DWI). The penalties for a first offense DWI are:



ยท Maximum 2 months in prison

ยท 8 points on your license



ยท Suspension of Your License



The penalties for a second offense DWI are:



ยท Maximum one year in prison



end ยท $ 500



ยท 8 points on your license



ยท Suspension of your license



Impaired



If your blood alcohol level is 08 or more, you will be charged with driving under the influence (DUI). The penalties for a first offense DUI are:



ยท Maximum one year in prison



end ยท $ 1,000



ยท 12 points on your license



ยท 45-day suspension of your license



Penalties for second offense DUI are:



ยท Maximum two years in prison, at least five days if the two sentences are in a period of five years



end ยท $ 2,000



ยท 12 points on your license



ยท 90 day suspension of your license



Driving under the influence of a controlled substance or dangerous



You do not need to be drunk to get a DUI. You will be responsible for driving under the influence of a controlled substance or dangerous if you are impaired by something other than alcohol or common non-prescription drugs. This includes a lack of illicit drugs and prescription medicines that prevent your ability to drive.



The penalties for a first offense are:



ยท Maximum one year in prison



end ยท $ 1,000



ยท Suspension of your license for a period exceeding one year



The penalties for a second offense are as follows:



ยท Maximum three years in prison



end ยท $ 3,000



ยท Revocation of the license and referral to the Medical Advisory Board



Penalties for each of these offenses are more important when transporting a minor. Your beliefs will be the first and second offenses. On your third conviction, all subsequent offenses will be DUI crimes.



Keep your license and insurance issues



If you have been charged with a DUI, you have ten days to request a hearing with.
