Beneficiary Rights

Beneficiary RightsWhat are the rights of the beneficiary of a death claim?

My ex-husband died in December 2006. We divorced in December 2004 after a 7 year marriage. He did not remarry until her death. It kept me as the beneficiary of one of his old pension. It was from a post he left before we got divorced.

Nationwide Retirement Solutions contacted me and asked my divorce decree. I asked why and the woman told me bluntly that it seeks to adjust the death benefit. She told me I was the beneficiary and that I should not say that to someone especially my ex mother.

I did not send the divorce yet. I decided to do a little research on this subject and know what my rights are. A lawyer online service Q and told me that I am entitled to the benefit regardless of divorce.

My feeling is that the country is trying to be "sneaky" in trying to change the beneficiary. Do I send my divorce at the national or continue to disclose this information?

As the beneficiary you have the right to receive the proceeds of the financial instrument. If the instrument is not included in his estate (which means you are the beneficiary of the instrument, rather than the will), it should do without you, without being subject to creditors to seize.

Understand that you are in any way responsible for any debt your ex-husband is so long that your name does not appear on all this. If they try to harass you, ask them to send copies of all documents by registered mail to your lawyer and ask that they perform all other communications through this person or company.

The reason they need to see the divorce decree is to see if it deals specifically with these benefits. If the order grants you either assets or specifically states you are not entitled to them, the insurance company must comply with the decree. If insurance is not specifically addressed, they would have to go to the Trust beneficiary on record.

Divorce does not change the beneficiary in a will. However, his mother may contest the will. Give a copy of the paperwork countries - to keep the originals.

FYI, you are not liable for the debts of your ex. Tell them he is dead and you were divorced 3 years ago. Tell them you also report them to the Attorney General if they continue to harassment.

I would contact an attorney in your area to help you.
